TERMS OF SERVICE

Decision support, with important limits.

These terms govern your use of myploton.earth. They explain what a plot report provides, what it cannot prove, and the responsibilities that remain with every buyer.

Effective20 August 2026Contactsupport@myploton.earth

1. Agreement and eligibility

By creating an account, submitting a plot or purchasing a report credit, you agree to these Terms of Service and the Privacy Policy. You must be at least 18 and legally able to enter a contract. If you use the service for another person or organisation, you confirm that you have authority to do so.

2. What myploton.earth provides

myploton.earth is decision-support software for individual buyers researching land in Portugal. It combines a user-supplied plot boundary and questionnaire with available public or licensed datasets. The service may provide a free machine preview, an automatically generated digital report, a personalised suitability interpretation, a goal-neutral strengths-and-concerns assessment and comparison between completed reports.

Each report revision is a dated snapshot of the submitted boundary, questionnaire, connected sources and analysis methods. A report is not continuously refreshed. Where the report offers a public-evidence refresh, that action rechecks the connected public sources against the exact saved boundary, creates a new identifiable revision and does not use a credit. Creating a separate report or comparison case may require another credit.

3. What a report does not provide

A report is not a cadastral survey, boundary determination, title search, valuation, legal opinion, planning certificate, building permission, engineering assessment, environmental assessment, hydrology study, soil test, agronomy advice, fire-safety assessment, insurance decision or guarantee that a proposed use is lawful or practical.

Public datasets can be delayed, incomplete, generalized, unavailable or wrong. A visible structure is not proof of legal pre-existence or rebuilding rights. A road or track is not proof of legal access. Mapped water is not proof of ownership, quality, dry-season yield or abstraction rights. A score must never replace documents, professional advice, authority confirmation or a site visit.

4. Accounts

You are responsible for accurate registration details and for activity under your account. Keep your password and linked Google account secure. Tell us promptly if you suspect unauthorised access. Reports are private to their owner unless the owner intentionally shares them.

5. Your boundaries, goals and materials

You are responsible for the accuracy and lawful use of every boundary and answer you submit. A user-drawn polygon is treated as a research area, not as proof of ownership or an official property boundary. You retain your rights in submitted material and give us a limited permission to store, process and display it only as needed to provide, secure and improve the requested automated report workflow.

Do not submit confidential third-party information, unlawful material, malware or personal data that you are not entitled to use.

6. Automated digital reports

The paid report is generated and delivered automatically from the submitted inputs and connected datasets. No person checks, approves, corrects, interprets or customises each purchased report. The report is not a professional certification and does not substitute for specialist due diligence.

If no submitted option appears suitable, a comparison may still identify the relatively stronger option while warning that neither is recommended. Missing evidence remains visible and is not converted into a favourable assumption.

7. Prices and report credits

When production payments are enabled, prices are shown in euros and include VAT where the checkout states this. An automated digital-report credit pays for analysis of one submitted plot. Credits do not expire and are not transferable. Comparison of already completed reports does not consume another credit.

An explicitly labelled sandbox checkout does not make a real charge. In production, Stripe hosts the checkout and provides the post-purchase invoice or receipt; credits are granted only after myploton.earth verifies Stripe's signed payment event.

If the required automated analysis fails before a report can be delivered, no credit should be consumed or the credit will be restored. Unlocking a ready report delivers the stored automated report immediately.

8. Cancellations and refunds

Unused production credits are generally non-refundable, except where applicable law requires otherwise. Consumers may have statutory cancellation or withdrawal rights. Where you expressly request immediate supply of digital analysis and acknowledge the legal effect of that request, those rights may change once performance begins or the digital content is supplied. Any checkout will present the required choice before charging you.

Nothing in these terms removes mandatory consumer remedies for a service that is not supplied as agreed.

9. Permitted use and intellectual property

You may use your report for personal land research and share it with advisers assisting your purchase. You may not resell reports, scrape or systematically extract the service, bypass access controls, impersonate another person, interfere with analysis or use the service to build a competing dataset without written permission.

The myploton.earth software, design, scoring methods and original explanatory content remain ours. Public-source data remains subject to its source terms and licences. Your access to a report does not transfer intellectual-property rights in the service or source datasets.

10. Beta availability and changes

The service is under active development. Evidence connectors, questions, scoring versions, prices and workflows may change. We may suspend a source or feature that is unsafe, unreliable or legally unavailable. We will not silently replace the stored evidence in an existing report; a correction or new revision should remain identifiable.

11. Responsibility and liability

You remain responsible for the property decision, independent verification and engagement of qualified professionals. To the fullest extent allowed by law, myploton.earth is not responsible for losses caused by relying on a report as if it were a professional approval, by inaccurate third-party data, by a wrongly drawn boundary, or by decisions made without appropriate due diligence.

Where liability cannot lawfully be excluded, our total liability connected with a paid report will not exceed the amount paid for the affected report, unless mandatory law requires a different remedy. Nothing excludes liability that cannot legally be limited, including liability for fraud or deliberate misconduct, or mandatory consumer rights.

12. Suspension and account closure

We may restrict or suspend an account to protect users, investigate misuse, comply with law or prevent harm to the service. You may request account and report deletion by contacting us. Some limited records may be retained where required for legal, security or dispute purposes.

13. Changes to these terms

We may update these terms as the beta develops. The effective date will change when a new version is published. Material changes affecting an existing paid service will be communicated where appropriate. Continued use after an update means the new terms apply to later activity, but it does not remove rights already acquired under mandatory law.

14. Applicable law and contact

Applicable consumer and data-protection laws continue to apply, including mandatory protections in your country of residence where they cannot be waived. Before starting formal proceedings, please contact us so we can try to resolve the issue.

Questions about these terms can be sent to support@myploton.earth.
